These Terms & Conditions apply to your use of https://www.imlwp.com (the “Site”) and the IMLWP text messaging program (the “SMS Program”) operated by Internal Medicine, Lipid & Wellness Practice (“IMLWP,” the “Practice”), legally organized as [LEGAL NAME].

1) Not Medical Advice

The Site provides general information only. It is not medical advice and does not replace evaluation by a clinician. Do not rely on the Site for diagnosis or treatment decisions.

2) No Emergencies

Do not use the Site or text messages for emergencies. If you believe you have a medical emergency, call 911 or go to the nearest emergency room.

3) No doctor–patient relationship created by the Site

Using the Site, sending a message, or requesting an appointment does not create a doctor–patient relationship. A doctor–patient relationship is established only after you complete the Practice’s intake process and the Practice confirms acceptance of you as a patient.

4) Contact forms, text messages, appointment requests, and response times

If the Site or SMS Program allows you to contact the Practice:

Messages may not be reviewed immediately.
Appointment requests are not confirmed until you receive confirmation from the Practice.
Do not include sensitive medical information in a general web form, text message, or unencrypted email. Use the patient portal or call the office.

5) Patient portal and third-party services

The Site links to an external patient portal (Elation Passport) and may link to other third-party sites (including Dr. Kordonowy’s Substack). Third-party services are not operated by the Practice, and their terms and privacy policies apply when you use them.

6) Acceptable use

You agree not to:

Use the Site for unlawful, harmful, or fraudulent purposes
Attempt to access non-public areas or interfere with Site security
Introduce malware or attempt to exploit vulnerabilities
Scrape or harvest information from the Site without permission

We may suspend or block access for misuse.

7) Intellectual property

The Site and its content (text, images, logos, design) are owned by or licensed to the Practice and are protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only.

8) Disclaimers

The Site is provided “as is” and “as available.” We do not guarantee the Site will be uninterrupted, error-free, or secure.

9) Limitation of liability

To the fullest extent permitted by law, the Practice is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site.

10) Changes to the Site or Terms

We may update the Site and these Terms at any time. Updated Terms will be posted with a new “Last Updated” date. Continued use of the Site means you accept the updated Terms.

11) Governing law and venue

These Terms are governed by Florida law, without regard to conflict-of-law principles. Venue for disputes relating to the Site will be in state or federal courts located in Lee County, Florida, unless otherwise required by law.

12) Text Messaging Terms (IMLWP Patient Texting)

Program name: IMLWP Patient Texting, from Internal Medicine, Lipid & Wellness Practice.

Program description: Patients who opt in receive appointment reminders and confirmations, rescheduling and cancellation notices, lab and pre-visit instructions, office hours and closure notices, and two-way text conversations with our staff about scheduling, billing and membership. We do not send marketing or promotional texts under this program.

How to opt in: Verbally, by telling our staff “yes” in the office or by phone after they read our texting disclosure, or by texting JOIN, START or YES to [TEXT NUMBER]. You will receive a confirmation text. Consent is not a condition of receiving care.

Message frequency: Message frequency varies based on your appointments and conversations with our office.

Cost: Message and data rates may apply. Check your mobile plan for details.

Help: Reply HELP to any message for help, or call (239) 362-3005 or email staff@imlwp.com.

Opt out: Reply STOP to any message to cancel at any time. You will receive one confirmation text and no further messages. Reply START to rejoin.

Carriers are not liable for any delayed or undelivered messages.

Security: Text messages are not encrypted. Do not text sensitive medical information. Test results and clinical details are shared through the patient portal.

Privacy: Your mobile number and text messaging consent are handled as described in our Privacy Policy at https://www.imlwp.com/privacy-policy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
